Peralending PRIVACY POLICY

U-PESO.PH LENDING CORPORATION. (“Peralending”, “We”, “Us”, or “Our”, for brevity) hereby adopts this Privacy Policy in compliance with the provisions of Republic Act No. 10173, entitled: An Act Protecting Individual Personal Information In Information And Communications Systems In The Government And The Private Sector, Creating For This Purpose A National Privacy Commission, And For Other Purposes, otherwise known as the “Data Privacy Act of 2012”.

For this purpose, this Privacy Policy ensures that the personal data gathered from our clients in the course of transactions, and in accordance with the nature of our business, shall remain secured and protected.

This Privacy Policy describes what information we collect from you, the purposes for which we collect and process it, how we use it, who we share it with, how long we retain it, and your rights in relation to it. You must read this Privacy Policy in its entirety.

This Privacy Policy applies in connection with your use of the Peralending Android mobile application found here (“Peralending App”, for brevity) and your use of our services through the (“Peralending App”, for brevity). This Privacy Policy does not apply to your use of the Company’s website, found at https://Peralending.com/ (the “Website”). Please see here for the privacy policy applicable to your use of our website.

Relative information collected

Borrower information, such as SSS, job information, emergency contact information, contact lists and others.
Sensitive information, such as GPS locations, mobile ID, app list, IP Base Station, Device infomation and other.
Other information, such as application usage, catalog of customer information and others.

Terms and Conditions:

Personally identifiable information

a. By registering an account with us, you are accepting the terms of the Terms and Conditions and consenting to our collection, usage, disclosure, retention, and protection of your personal information as described herein;
b. Personal data including your name, age, photos, fingerprints, and other biometric data. (e.g., facial recognition and voice recognition), mobile number/s, mobile phone usage data, employment details, income, financial data, financial profile, credit standing, loan payment history, and other information that may be required to process your loan application.
c. Other information that you provide to us but that does not identify you personally, such as records of your visits and information that you submit when using the website;
d. Other information that the record you click our app and operation,such as the record you change your ID NO or ID Type.

Collected information

We collected the information for the following purposes, but not limited to:

a. To process your transaction;
b. To verify your actual identity;
c. To determine if you’re eligible for a loan;
d. To disburse loan and collect repayment for your service;
e. To have credibility built in your account;
f. To comply with applicable rules, regulations, and laws;
g. To detect and prevent fraud;
h. To rate your loan application history and confirm your job data;
i. To develop more apps feature that needs to meet clients needs;
j. To know our latest services provide, new notifications, and offers etc;
k. To assess your risk profile and to recommend suitable products.
l. We need to obtain your call records to ensure that real users use the app in a normal environment, rather than using a simulator for fraudulent behavior.Call record information will be uploaded to https://api.peralending.com/ And it will not be shared with third parties. We will not disclose or share your information.

As part of our loan application, we need users to select the contact information of their friends or family from their contacts. In this regard, when submitting a form on our platform, we collect your contact information so that you can automatically fill in the data during the loan application process. If available, please supplement your financial situation and help us determine loan eligibility and risk assessment. Contact information will not be used for any other services or users, nor will it be provided to any third party, but contact information may be used by us or a nominated third party when a loan is overdue.These data will be encrypted and uploaded via the HTTPS protocol https://saas.peralending.com/ . We never share the data with third parties.

Peralending collects your application list, including package name, package version, app installed time to build and complete our risk management model. Without the model, we would not be able to provide financial service to you. Your data will be transmitted and stored to our server: ( http://peralending.com ) over a secure encryption technology. We will not share your data to third parties for any reasons, such as for the purposes of analysis and sale.

Phone Number

We will upload you and your contact phone number to http://peralending.com ).com to verify the authenticity of your identity. Identity verification is done through the contact to ensure the security of loan funds and the phone number will be removed once your risk profile is determined.

Application list

We collect your application list, including package name, package version, app installed time to build and complete our risk management model. Without the model, we would not be able to provide financial service to you. Your data will be transmitted and stored to our server: ( https://peralending.com ) over a secure encryption technology. We will not share your data to third parties for any reasons, such as for the purposes of analysis and sale.

Image infomation

When you need to upload pictures such as ID photos/selfie photos during the process of filling in the information, we will ask your consent to obtain storage permissions and help you complete the loan application steps.

Peralending may collect your information from:

You, when download the Peralending App and/or indicate that you want to apply for a loan;

Your other interactions with us, including Information you may voluntarily share with our customer support team or other Peralending employees or agents;

Your mobile device (e.g., mobile device data, location data, transaction data, Peralending App usage and/or phone data as more fully described above);

Credit reference agencies (who may check your Information against other databases – public and private – to which they have access) or fraud prevention agencies;

Third parties and other publicly available sources, with your consent, when necessary (e.g., we may receive Information from financial rails (or other disbursement channel vendors) or other business partners that may assist us in providing services to you).

Collection and processing of your Information by Peralending is necessary for the provision of Peralending’s products and services and/or to comply with applicable legal and regulatory requirements to which you and/or Peralending is subject. Aside from such cases, we do not collect Information without your specific prior consent.

How we use and share information?

To assess your eligibility to use our products or services (including, but not limited to, by assessing your creditworthiness, determining whether you can afford a product or service you requested and/or determining whether you are eligible for additional benefits of an existing product);

To service your loan with Peralending (including, but not limited to, by processing your transactions and processing disbursement of your loan and collecting repayment of your loan);

To verify your identity and/or other information you have provided to us;

To detect, combat and prevent fraud, attempted fraud, money laundering and/or other illegal uses of our services;

To analyze customer behavior;

To administer out systems, maintain service quality and compile general usage statistics;

To analyze and improve our services;

To troubleshoot any problems you or other customers encounter with Peralending’s services;

To comply with applicable laws, regulations, and rules, such as those relating to “know-your-customer” and/or anti-money laundering;

To the extent you have not objected to the use of your information for direct marketing purposes after proper notification, to send you marketing or advertising notices or other promotional offers;

To provide service updates;

To provide staff training (where we may monitor or record customer interactions);

To interface with credit reference or fraud prevention agencies;

To provide customer service or support;

To contact you by telephone using autodialed or prerecorded message calls or text (SMS) messages (if applicable) as authorized for the purposes described in this Privacy Policy.

We process your information for the purposes set out above on the following grounds:

In connection with the nature of our business in (1) providing you with credit and/or other financial or technological products or services, (2) operating our business, (3) marketing our products and services to you and others and (4) administering our systems and keeping our records up to date;

To carry out our obligations to you as a result of any contracts or agreements entered into between you and us (i.e., where necessary for the adequate performance of our contract with you and/or to take steps requested by you prior to entering into a contract with you); and/or With your prior consent.

Who do we share your Information with?

For how long will we retain your Information?

Your Information will be stored or retained by Peralending and its transferees only for so long as necessary for the purposes listed in Sections 2 and 10 of this Privacy Policy, and for a reasonable time thereafter for the delivery of our products and completion of our services.

We may also retain your Information (i) as long as necessary to comply with any legal obligation; (ii) whenever such is authorized under the law; and (iii) for the establishment of legal defenses.

Where do we process, store or transfer your information?

We may transfer your Information outside of the Philippines, either to the United States, or Singapore, and/or to the extent we provide prior notice to you, to jurisdictions that may have data protection laws that are less stringent than those of the Philippines. When we do so, we will ensure that adequate safeguards are in place in accordance with applicable law and/or the Philippines’data protection requirements. The safeguards we will use will depend on the circumstances and the party to whom we transfer your Information. Your Information may be processed by any of the parties described in Section 3. Peralending will use all reasonable and appropriate efforts as required by applicable law to protect your Information.

Automated decisions and profiling

We may make certain decisions in relation to our provision of our products and services to you by using automated decision-making processes, without human involvement.

Lending decisions

When you apply for a loan, we shall use automated processing to decide whether to commence with the transaction or otherwise based on your eligibility for our products and services. This automated processing enables us to provide rapid, responsive and tailored credit services to customers who may not have credit histories, prior bank or other financial data or income from formal sources.

Our credit and underwriting models utilize machine-learning technology to process your Information and assess your credit-worthiness. The associated processing of your Information is automated and little to no human intervention is involved. Using such automated processes to assess your creditworthiness means we may automatically decide that you may be ineligible for a loan or ineligible for a loan of a particular amount or tenure.

Our credit and underwriting models are regularly tested to ensure they remain fair, accurate and unbiased.

Detecting fraud

Peralending also utilizes automated processes to detect, combat and prevent fraud. Our fraud models may automatically decide that a certain individual poses a fraud or money laundering risk (e.g., if our processing reveals information or behavior consistent with money laundering or known fraudulent activity, if the activity is inconsistent with prior activity on our platform or if an individual appears to be hiding their true identity). If our fraud models determine that processing of a transaction or approving a certain individual creates a risk of fraud, that individual’s access may be suspended or refused.

Your rights in relation to automated decision-making

In the event that your loan application is denied or your loan is declined, or you are found ineligible for other or associated products or services as a result of an automated credit, underwriting or fraud decision, you may request that said decision be reviewed through cs@Peralending.com.

Rights to notice and consent

We shall provide you with the necessary information as to how we collect your Information, how we use the same (and our legal basis for doing so), who we share your Information with, where we obtained your Information and your rights as a data subject. This information is provided within the Peralending App and in this Privacy Policy.

You privacy controls

You have the rights to:

1. Access your personal data in possession of the Platform;

2. Revoke the consent to the processing of your personal data, revise and/or delete the personal data in possession of the Platform unless the conservation of the said data is mandatory by laws and regulations, without retroactive effects, in all those cases in which such revocation, revision, and deletion do not imply the impossibility of fulfilling obligation derived from a current legal relationship between you and the Platform or when it comes to non-necessary purposes.

The exercise of the aforementioned rights must be carried out in writing by email to the following email address: cs@peralending.ph. After the application has been submitted in the aforementioned terms, the Platform will issue the adopted determination.
